01
Accepting these terms
These Terms of Use apply to the Cubmee website and the Cubmee apps we provide, including Cubmee Colouring and Cubmee Memory. By downloading, accessing or using a Cubmee app or this website, you agree to these terms.
A parent, carer or other responsible adult must accept these terms for a child and is responsible for supervising the child’s use of Cubmee. If you do not agree, do not use the service.
02
Using Cubmee
Cubmee grants you a limited, personal, non-exclusive and non-transferable right to use the apps and website for lawful personal, family or educational activity. You must follow the App Store usage rules and must not copy, sell, redistribute, reverse engineer or misuse Cubmee except where applicable law expressly allows it.
Apple’s standard Licensed Application End User License Agreement also applies to apps obtained through the App Store unless we provide a valid custom agreement. If these terms conflict with mandatory App Store terms, those mandatory terms take priority.
03
Children and adult supervision
Cubmee is designed to support gentle creative play, not to replace adult care, supervision, teaching or professional advice. Adults are responsible for deciding whether an app is appropriate for a child and for managing the device, Photos permissions, downloads and any future purchases.
04
Artwork and Cubmee’s world
Cubmee’s characters, names, illustrations, app designs, stories, text and other supplied materials are owned by or licensed to us and are protected by intellectual property laws. These terms do not transfer ownership of that material.
You may keep, display and share pictures created through Cubmee Colouring for personal, family or classroom use. You retain any rights you have in your own creative contribution, while the underlying Cubmee character artwork and supplied templates remain ours. You may not sell or commercially exploit Cubmee artwork without written permission.
05
Local files and Photos
Cubmee Colouring stores saved artwork on the device. You are responsible for maintaining any device backups and for exporting pictures you want to keep before deleting the app or device data. When you choose to save a picture to Photos, the app requests the relevant iOS permission and adds that picture to the device’s library.
06
Purchases
The current Cubmee apps do not offer in-app purchases. If purchases are introduced, we will clearly identify the price and what is included, protect purchase links with an appropriate parental gate, support restoration where required and update these terms before the feature becomes available.
Apple processes App Store payments, refunds and payment information under Apple’s terms.
07
Availability and changes
We may improve, update, replace or discontinue a Cubmee feature or app. We aim to preserve locally saved creative work during ordinary updates, but we cannot promise uninterrupted availability or compatibility with every device and operating-system version.
08
Warranties and responsibility
Cubmee is provided with due care but, to the extent permitted by law, without a promise that it will always be uninterrupted or error-free. We are not responsible for losses caused by device failure, deletion of local data, unsupported modification or use that breaches these terms.
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
09
Contact, governing law and updates
Questions from a parent or carer can be sent through Ocintra’s contact page. These terms are governed by the laws of Victoria, Australia, subject to any mandatory law that applies where you live.
We may update these terms when Cubmee changes. Material changes will be reflected by the effective date above and, where appropriate, explained through the app or website.
